PDS Workshops

LES Professional Development Series (PDS)

Workshops supporting the Intermediate level of the LES Professional Development Series (PDS) will be presented three times per year, at the LES seasonal and annual meetings.

The PDS Intermediate Workshop Requirement

In addition to the four-day Intermediate course (201-205), participants wishing to complete the Intermediate level and receive a Certificate of Completion must attend a total of four PDS Workshops. These interactive Workshops, offered in conjunction with LES annual and seasonal meetings, are intended to support and extend the learning from the course. The content of each Workshop aligns with that of one particular Intermediate course segment: Legal, IA Strategy, Valuation, Negotiation and Ethics, and Licensing. LES strongly recommends that all students complete at least one PDS Valuation Workshop and that all non-attorneys take at least one PDS Legal Workshop.

There are no pre-requisites for attending the PDS Workshops which are open to everyone. Students may attend PDS Workshops before or after attending the course. However, the content is at the Intermediate level and class size is limited to 25 participants in each Workshop.

Tickets for any remaining spaces will be available at the LES Registration Desk onsite at each meeting. There is no additional fee for these PDS Workshops other than paying the appropriate registration fees for LES seasonal and annual meetings.

Intermediate PDS Workshop: Application of Private Equity and Leveraged Finance Investing to Intellectual Property

Public market recognition of value, along with new and developing accounting rules, has raised attention to IP as an asset class. No longer the purview of patent attorneys and boutique consultancies, the largest investment banks, private equity partnerships and strategy firms are now actively seeking to exploit IP. This PDS Workshop will provide a brief history of how we got to this point, details of newly emerging strategies and a prospective on where the industry is heading:

Intermediate PDS Workshop: Royalty Audits-Why License If You Don't Intend To Collect What You Are Due?

Companies that license their technology, trademarks and other intellectual assets to add to the bottom line may actually be overlooking untapped revenues: Ð revenues that have been earned but not collected. Royalties due under an existing license agreement resulting from underreporting by the licensee may or may not be intentional. The purpose of this PDS Workshop is to educate licensors about the purpose and value of royalty audits as well as the licensor's rights to audit the royalties reported by a licensee. We will cover key topics such as the following:

  • Uncovering problems with royalty reporting
  • Overcoming common causes of calculation errors
  • Completing royalty audits that ensure accurate receipt of royalties due
  • Helping the licensor find solutions to inaccuracies
  • Recovering unpaid royalties from intentional underpayments
  • Preserving the licensor/licensee relationship
  • Minimizing royalty reporting errors.
