A. ROUNDTABLE DISCUSSION:
- Structuring Intellectual Property Ownership in Joint Development Agreements
Joint Development Agreements have become increasingly common as a means to reduce the cost of development and to leverage core competencies of the respective parties. Such agreements require that the parties decide how intellectual property rights applicable to the joint effort should be allocated. The discussion will focus on various allocation strategies and the pros and cons of each. The discussion will be led by Bruce T. Neel of Gammage and Burnham.
- SCO's Attack on Linux
Utah based SCO has commenced suit against several companies claiming that its intellectual property rights to its Unix Operating System have been infringed as a result of the incorporation of portions of the source code into the open source Linux Operating System. Given that Linux use among commercial entities continues to grow rapidly, SCO's attack will likely have wide-ranging consequences that could affect every Linux user. The discussion will focus on the licensing issues arising from the legal arguments for and against SCO's assertion of alleged infringement. The discussion will be led by Paul E. Burns of Steptoe & Johnson LLP.
