An Overview and Update on the State of Open Source Licensing and Collaborative
Development Models

Presenters:
Richard Fontana, Counsel with the Software Freedom Law
Center. Richard Fontana joined the SFLC after working as an associate
at intellectual property boutique law firms in Chicago and Seattle. Earlier in
his career he was an associate in the litigation department of Rogers & Wells
(now Clifford Chance) in New York. Mr. Fontana graduated cum laude from the University
of Michigan Law School, where he was an editor of the University of Michigan
Journal of Law Reform. He received a master's degree in computer science from
Yale University and a bachelor's degree in history from Wesleyan University.
Mr. Fontana is admitted to practice in the State of New York and before the United
States Patent and Trademark Office.
Karen F. Copenhaver, Partner,
Choate, Hall & Stewart LLP: Karen Copenhaver
is a partner in Choate’s Business & Technology Group. Ms. Copenhaver’s
practice focuses on technology transfer and licensing of intellectual property,
particularly in the areas of software licensing and open source business models. From
2004 through 2006, Ms. Copenhaver was executive vice president and general counsel
of Black Duck Software, Inc., where she was instrumental in establishing automated
methods of software compliance management as an industry best practice. Before
joining Black Duck, Ms. Copenhaver was a partner in the Patent and Intellectual
Property Group of Testa, Hurwitz & Thibeault LLP from 1994 through 2004. She
began her legal career in 1979 at IBM Corporation and served as, among other
positions, site counsel for the IBM Microelectronics Division, Semiconductor
Design and Manufacturing facility in Essex Junction, Vermont. She was
a Partner at Brown & Bain LLP in Phoenix, AZ and Palo Alto, CA from
1991 through 1994. Ms. Copenhaver currently serves on Black Duck's Board
of Advisors, on the Board of Advisors of Design that Matters, and on the Board
of Directors of the Center for Women and Enterprise.
Ms. Copenhaver will give a high level overview of the impact and opportunity
of collaborative development models. Mr. Fontana will join us to conduct
a discussion of the recently release version 3 of the draft GPL 3, that is
currently under consideration. Richard has been working with the GPL
3 Committees and is one of the primary drafters of the license and the explanatory
documents that accompany the drafts.
