Navigating the Murky Waters Around the Doctrines of Patent Exhaustion and Implied License (1.0 CLE Credit Applied for)
In recent years there has been a resurgence of assertion of the defenses of patent exhaustion and implied license in the patent litigation and licensing contexts.
Yet the doctrines are frequently confused and often misconstrued. Join us in a lunch time journey through the murky waters surrounding these doctrines in an attempt to illuminate a path to some useful and practical guidelines concerning the impact of the doctrines in structuring licensing arrangements.

Jennifer Wuamett is Vice President and Chief Intellectual Property Counsel of Freescale Semiconductor, Inc. Prior to joining Freescale in April of 2004, Jennifer was a member of the Motorola Law Department serving in a variety of roles, most recently acting as an IP Law Director with Motorola's Strategic Intellectual Property Counseling Team. Before joining Motorola, Jennifer was an Intellectual Property Attorney in private practice with the national law firm Quarles & Brady.
Jennifer received her Law Degree from the Arizona State University College of Law, where she graduated Magna Cum Laude and was the 1995 recipient of the Arizona State University College of Law's Outstanding Graduate Award. She served as Editor-in-Chief of the Arizona State Law Journal from 1994-1995.
Barry Bumgardner is an IP Law Director at Freescale Semiconductor. Barry worked at Vinson & Elkins for six years before joining Freescale. Barry graduated from Texas A&M in 1990 with a B.S. in Electrical Engineering. He went on to graduate from the University of Texas School of Law in 1995.
