IP Litigation: Practical Issues about Electronic Records, Digital Forensics and Electronic Evidence
Digital devices offer increased exchange of knowledge and communications for most sectors of our modern economies. These connected devices offer both convenience and richness in a wide range of business and personal communications. However, with these benefits, there are associated tradeoffs dealing with privacy, trustworthy communications, risks and opportunities dealing with corporate records, discovery and litigation. The talk will focus on typical and sometimes non-obvious sources of digital information, how it may be recovered, planning for both mitigation of risks in managing digital information and lastly the uses and misuses of digital forensics and electronic discovery in disputes and litigation.
A short IP case is presented in order to establish some context and critical dialogue. In this manner, a non-technical perspective dealing with certain forensic concepts, guidelines and a checklist is presented for those legal and management professional interested in the uses and misuses of electronic records, digital forensics and electronic evidence. Some demonstrative exhibits will be used to make some useful points and stimulate the exchange of ideas.

Dr. Larry Leibrock, CTO, eForensics.
Larry Leibrock has conducted over 250 forensics examinations and testified in over 43 judicial proceedings, and taught forensics tutorials in 7 countries. These investigations have involved, administrative disputes, alleged possession of contraband, and authenticity of digital photos, proprietary software authorship, network intrusions, white collar crimes and capitol espionage cases. He has served as a special master in dealing with intellectual property matters and allegations of spoliation. He is retired from the University of Texas – School of Business where he last served as Chief Technology Officer for the Business School.
Welcome to the Jungle: Navigating the eDiscovery Landscape
Feeling the information overload? Your not alone, a recent study by the University of California at Berkeley estimated that more than 20 exabytes (20 billion gigabytes) of data has been created and that number rises every day. It is a jungle of eDiscovery. On average, an office worker in the U.S. sends and receives as many as 200 e-mail messages each day. The size of business e-mail volumes sent annually worldwide exceeded 1 exabyte for the first time in 2003, an increase of 41% from 2002. The number of person-to-person e-mails sent annually worldwide is estimated to have been 7.8 trillion in 2004 and projected to reach 10.4 trillion in 2008. (IDC, August 2004). That is a lot of email, and email is becoming the cornerstone of documents produced in litigation. It is not longer economical, or even possible, to print to paper or even review electronically all that email (and other electronic documents). We are being challenged as an industry to find faster, accurate more efficient ways to get through all that information. This presentation will show you current technology to help us navigate the eDiscovery landscape as well as predict the future of where intelligent technology is headed and how the you can and will play a vital role in that future.

Mark G. Walker, Director of Solutions Engineering.
Mark G. Walker is the Director of Solutions Engineering for the litigation support provider RLS Legal Solutions, where he holds national responsibility for working with law firms to develop solutions to meet their needs using technology. He has extensive knowledge and experience in the use of technology in litigation both inside and outside the courtroom. His background is among the most diverse in the industry. Mark began his career as a court Coordinator for the 125th Judicial District in Harris County, Texas. He has built litigation support departments from the ground up at both Brown McCarroll and Jackson Walker. Mark understands the corporate law office having been a member of Advanced Micro Devices’ law department. Prior to AMD in July 2000, Mark was a senior paralegal at Susman Godfrey, LLP where he spent 13 years as one of that firm's top trial legal assistants. He is a frequent seminar speaker and has authored a number of articles and books, including Paralegal Practice Guides for PESI Law: Discovery Skills, Preparing for Trial: Plaintiff's Edition and Preparing for Trial: Defendant's Edition. He is a recipient of PESI's 2001 Excellence in Education Award. He is a three time recipient of Advanced Micro Devices “Author of Merit” award. Mark was recently featured in Legal Assistant Today’s September – October, 2003 edition on technology.
