International Outsourcing and the Challenge of Developing and Protecting IP in Transnational Arrangements

Offshore outsourcing is raising discussions throughout the United States as more companies consider outsourcing software programming and coding, call center monitoring and accounting functions, among others, to countries such as India, China and Canada. Many companies such as BMC Software, Microsoft and GE have engaged in offshore outsourcing.

During this meeting, we will examine certain aspects of offshore outsourcing. We will also identify and discuss some of the legal challenges presented for developing and protecting IP rights in transnational arrangements.

Cindy LaFrance, Partner at LaFrance & Associates, will speak on the trends, triggers and tripwires involved in offshore outsourcing to India. Cindy is a veteran of the high tech industry, with over twenty years experience in product management, development management, sales and consulting for companies such as BMC Software, Schlumberger, Digital Equipment Corporation, RCA and Dupont. Cindy is also the author of The Outsourcing Avalancheª Seminar Series, designed to educate on the different dimensions of leadership and particular challenges faced in offshore outsourcing.

Jeffrey Mills, Senior Counsel at Fulbright and Jaworski L.L.P., will discuss the legal issues arising from the development and protection of IP rights in an international outsourcing environment. His presentation will look briefly at concerns posed when protectable inventions or discoveries are made in other countries and concerns raised when technology is transferred to or from the U.S.
