Emerging Technology Transfer Issues Under U.S. Export Controls and Embargoes

The Program will include:

  • how U.S. export controls and economic sanctions affect transfer, use, development, manufacture, and marketing of intellectual property;
  • "Deemed Export" of technology: how U.S. law controls disclosure of technology to foreign nationals in the United States and abroad;
  • license provisions for compliance with U.S. law; and
  • Emerging Issues: Licensing vs. other modes of transfer of intellectual property to parties doing business in sanctioned countries.

J. Scott Maberry, Counsel, Fulbright & Jaworski L.L.P. (Washington, D.C.)

Mr. Maberry's areas of expertise include counseling clients on compliance with U.S. and multilateral regulations concerning export controls, anti-terrorism, anti-bribery, economic sanctions, anti-boycott controls, and Customs; representing clients in U.S. international trade enforcement and regulatory actions, including antidumping, countervailing duties, and other trade remedy proceedings; and counseling and representing government clients in negotiations and dispute resolution under the World Trade Organization (WTO), North American Free Trade Agreement (NAFTA), and other multilateral and bilateral agreements.

His practice includes representation of clients before the U.S. Department of Commerce, International Trade Commission (ITC), Department of State Office of Defense Trade Controls (ODTC), Department of Treasury Office of Foreign Assets Control (OFAC), the Committee on Foreign Investment in the United States (CFIUS), Federal courts and grand jury proceedings, WTO and NAFTA dispute resolution panels.
