How to Draft an Effective ADR Clause and Avoid Arbitration Clause Disasters

Robert Matlin, District Vice President of the American Arbitration
Association and Alan S. Wernick, founding Principal of Wernick & Associates,
Ltd., will share their expertise on drafting effective alternative dispute
resolution (ADR) clauses. Our speakers will also share strategies for
avoiding arbitration clause disasters in intellectual property licensing and
information technology disputes.
Robert Matlin, District Vice President of the American Arbitration Association,
conducts presentations on a variety of ADR-related topics and assists businesses
with the design of ADR programs. He serves as an Adjunct Professor of
Law, teaching a course in mediation at the DePaul University School of Law. A
graduate of the University of Illinois at Urbana-Champaign and Boston University
School of Law, Mr. Matlin practiced for a number of years as a Director and
Senior Counsel in the Corporate Law Department – Litigation Division
of the CNA Insurance Companies, where he supervised a wide range of commercial
litigation. Mr. Matlin is currently co-chair of the Chicago Bar Association
Alternative Dispute Resolution Committee and is a certified mediator with the
Circuit Court of Cook County and Center for Conflict Resolution.
Alan Wernick, a Martindale Hubbell AV rated attorney and leading lawyer in
computer and technology law, has more than 25 years of experience and leadership
roles in the private practice of law in information technology and intellectual
property, as in-house general counsel, with the successful handling of numerous
large complex transactions, in strategic counseling of clients in the management
of their technology and intellectual capital assets, and in dispute resolution
including litigation, arbitration, mediation, and appeals. Mr. Wernick
utilizes his education and experience in law, accounting and technology in
understanding clients’ objectives and counseling clients in connection
with their legal risk management.
