SPECIAL MEETING "The Supreme Court Rules - Festo Revisited"
Without a doubt, Cecilia Lofters' insight was highly valued when she visited our LES Chapter in October 2001 to discuss the Supreme Court Festo Case. Now the ruling is in and we have invited Cecilia to return and share her thoughts with us. Festo is likely to affect the prosecution and defense of a broad range of United States Patents. The doctrine of equivalents (DOE) has been one of the most important elements in patent law; and, with the principle upheld, many of us are asking questions like, "What should I do differently when prosecuting patents and enforcing them? Did the Supreme Court fully uphold the doctrine? How should I view prosecution history in light of the ruling? What questions should I be asking before I move ahead with enforcement? Are intellectual property valuations changed because of the ruling?"
Cecilia has promised to address these questions and more in this year's, 'Festo Revisited" Special LES Meeting. A most informative discussion is guaranteed for all.
Cecilia graduated from MIT in 1983 with a Bachelor of Science degree in Mechanical Engineering and obtained an MS degree in Mechanical Engineering from U.C. Berkeley in 1984. Cecilia earned a JD degree cum laude from Harvard Law School in 1987. After law school she joined the New York office of Fish & Neave where she was an associate until 1992. In 1992 she joined the law firm of White & Case LLP where she practiced for eight years in the Intellectual Property Group handling IP prosecution, litigation and licensing matters. Cecilia was named a partner at White & Case in 1997 where she practiced until September 2000 prior to joining GE. Cecilia has written and lectured on construction of patent claims, business method patent prosecution and trade secret issues. She is a member of the American Intellectual Property Law Association (AIPLA), and the Licensing Executive Society and is on the Board of Directors of the New York Intellectual Property Law Association. Cecilia lives in Stamford, Connecticut with her husband and three children.
