Patent Reality: The Hatch-Waxman Act One Hundred Eighty-Day "ANDA" Exclusivity Period
In an effort to lower the cost of prescription drugs, Congress provided special benefits to generic drug producers, including the ability to challenge a patent and attempt to enter the market before patent expiration. The incentives offered by the Patent Office must balance against these incentives provided by Congress. More recently, the FDA proposed new regulations as a response to related court decisions; but recent court decisions appear inconsistent with the FDA's proposal. Confused? This is the new reality of pharmaceutical patents.
Stanley H. Lieberman joins us in April to help understand the new pharmaceutical landscape including understanding the effects the Hatch-Waxman Act, also known as the Drug Price Competition and Patent Term Restoration Act of 1984. The April LES meeting promises to be of great interest for all licensing executives, and is essential if you license life sciences technologies.
Stanley H. Lieberstein brings extensive experience in Hatch-Waxman Act litigation, licensing, and client representation in the pharmaceutical industry. His distinguished career has included positions at the USPTO, United States Federal Circuit Court of Appeals, and Hoffman-Larouche, Inc. before joining two of the world's most prestigious legal firms. Lieberstein earned his law degree from Brooklyn Law School after studying advanced Chemistry at Brooklyn Poly Tech. He is the author of Who Owns What is in Your Head?, a book about trade secret/unfair competition law and ownership rights to intellectual property, published by E. P. Dutton.
