European Community Patent - Is it Finally Here?

After talking about having a single unitary patent or Community Patent across all of the European Union member states for the best part of 40 years, the member states will probably soon adopt a Regulation establishing the Community Patent system.

  • What difference will its establishment make to US clients seeking patent protection in the 15 (soon to be 25) member states of the EU and/or facing infringement challenges from holders of Community Patents?
  • What difference will it make to US practitioners themselves and what risks will they be exposed to when seeking Community Patents?
The speaker, Dick Fawcett is a Fellow of the Chartered Institute of Patent Agents and a European Patent Attorney. He is a past President of the Institute and is now a member of the Institute's Council and Chairman of its Patents Committee. He is a past President and now a Vice President of the Trade Marks Patents and Designs Federation, a Vice Chairman of the ICC's Commission on Intellectual Property and Chairman of ICC - UK's Committee on Intellectual Property. He was formerly Group Patent Counsel of British Petroleum, and is now an intellectual property consultant to several law firms in London and Washington. He will try to answer these questions as well as explain the likely structure of the new system.
