Topic:
Extraterritorial Issues Under U.S. Patent Law
Jim Wallace will address the extraterritorial issues presented in the NTP
v RIM BlackBerry litigation and the different approaches taken by the U.S.
Court of Appeals for the Federal Circuit (CAFC) respecting system and method
claims. He will give examples of how thoughtful patent claim drafting
can overcome some of the negative impact the CAFC decision has on method claims
when one or more of the method steps are performed outside the country.
Jim Wallace has more than 30 years of experience litigating patents in the
fields of communications satellites, data transmission, network interface devices,
Internet business methods, pharmaceuticals, biotechnology and semiconductors.
A founding partner of the firm, he was named by Legal Times as a "Leading
Intellectual Property Attorney" and has been recognized as one of the “Best
Lawyers in America” in intellectual property law. Most recently,
he was the lead attorney for NTP and secured on their behalf a $612.5
million patent infringement settlement with Research In Motion Ltd. (RIM),
the maker of the popular BlackBerry wireless email devices. In addition,
he has litigated numerous pharmaceutical patent cases, including loratadine
(Claritin®), omeprazole (Prilosec®), oxybutynin (Ditropan XL®),
carbidopa/levodopa, tamoxifen (Nolvadex®), allopurinol and t-PA (Activase®).
