Title:
Valuing and Pricing IP for Licensing and Litigation

Mr. Jarosz will discuss methods to determine the value of IP and the price at which it will be shared in a licensing deal and in a litigation context. He will explain that a negotiated price is often lower than its intrinsic value, and differs across licensees and across settings. Mr. Jarosz will describe the three broad methods by which licensed IP is valued, the various forms of each of those valuation methods, the strengths and weaknesses of each form and the licensing and litigation settings in which each of the valuation tools is most appropriate. Mr. Jarosz will then describe and evaluate four tools that can be used in determining the ultimate price at which IP should be shared in a licensing deal and in a litigation. Those tools have varying forms of sophistication and provide varying forms of assistance in closing a deal.

Speaker Bio:
John Jarosz, Managing Principal, The Analysis Group, specializes in applied microeconomics and industrial organization. He has performed research, given economic testimony, and provided strategy consultation in matters involving commercial damages, intellectual property, licensing, and antitrust. Mr. Jarosz has significant expertise evaluating and testifying on damages in patent, copyright, trademark, trade secret, and unfair competition cases. He also does substantial work in non-litigations settings, helping companies value their technology and that of others for sale, tax and licensing purposes. Mr. Jarosz is a member of the American Law and Economics Association and the American and Wisconsin Bar Associations. He is an accomplished speaker at industry and legal conferences and served as both a columnist and advisory board member of The IP Litigator. He has published articles on damages and intellectual property valuation issues in a variety of academic and professional journals. Mr. Jarosz is currently Chairman of the Licensing Executives Society's Valuation and Taxation Committee.
