Topic: Lessons from Trademark Law: The Application of Surveys in Patent Litigation, Patent Valuation and Patent Licensing.
Most intellectual property lawyers understand the significant role surveys play in trademark infringement and other Lanham Act cases, but relatively few are likely to have considered using such research in patent infringement matters other than those involving design patents. Historically, the use of surveys has been limited in court because of hearsay issues. However, because advances in surveys and other forms of public opinion research over the past 25 years have created a well-developed scientific and professional community supporting their use, litigators and the courts are beginning to recognize their utility beyond the traditional confines of Lanham Act litigation. In her presentation, Krista Holt will discuss recent Federal District court decisions that address the increasing use of surveys in patent litigation, and how the lack of a survey by an expert could be grounds for exclusion. Additionally, she will discuss surveys as a tool when valuing patents as well as licensing patents.
