Licensing Considerations Post-eBay
The Supreme Court's ruling in eBay
v. MercExchange has changed the landscape in the patent community.
Granting permanent injunctions in patent infringement cases is no longer
automatic. Ed Gold will first review past trends in patent damages awards
and provide interesting findings from PricewaterhouseCoopers' recent extensive
study of damages in patent matters. He will then consider the
post-Ebay environment through an examination of recent patent
decisions from the point of view of a damages expert. With these
decisions as context, he will explore the economics of demonstrating
irreparable harm and consider the implications on licensing and damages
of recent decisions in which no injunction was granted.
