John ("Jack") D. McConaghy, Partner, Connolly, Bove, Lodge & Hutz LLP

John ("Jack") D. McConaghy is a partner in the Intellectual Property Group of Connolly, Bove, Lodge & Hutz LLP. He is also the Los Angeles Office’s Partner-in-Charge, a member of the firm’s Management Committee and a member of the firm's Associate Evaluation Committee. Jack represents clients in a variety of areas including patent counseling and opinions, due diligence, licensing and transactions, interferences, litigation, prosecution, reissue and reexamination, trademarks, trademark and copyright litigation and unfair competition and trade secret law in the mechanical, electrical and software arts. Jack is a lecturer and author, both domestically and internationally. He is also a founding member of the Los Angeles Intellectual Property Inn of Court. Jack has been recognized by both Best Lawyers in America and Super Lawyers as a recommended intellectual property law practitioner in California.

PROGRAM DESCRIPTION:
The U.S. is currently seeing an assault made on its patent system. The familiar system of the last twenty plus years, familiar to lawyers, patentees, and assignees alike, which spawned a vigorous technological renaissance in the United States, is literally being besieged. As patent rights universally accepted and applied become increasingly curtailed through the U.S. court system and legislative action, many believe that contractual rights between entities will gain in importance. One component of those contractual relationships is the package of rights often referred to as an NDA, or nondisclosure agreement. Jack will provide his insight as to the impact which the current and proposed changes in the patent law will have on the future of innovation, particularly in California. He will then follow with comments regarding the increasing importance of contractual rights in agreements, with an emphasis on the enhanced role of the NDA, its advantages, and along the way, point out traps for the unwary.
