TOPIC:
Royalty Rates and Patent Pools: An Infringement Assessment

SPEAKERS:
Jeff Kinrich, Managing Principal, Analysis Group, Inc.
Russ Mangum, Ph.D., Vice President & Director, Nathan Associates, Inc.

Jeffrey (Jeff) H. Kinrich. Mr. Kinrich consults on cases involving financial and economic analysis, accounting, statistics, and mathematical modeling. Over his twenty-five year career, he has directed numerous large-scale analyses involving a broad range of litigation areas. He specializes in damage quantification and valuation in the areas of intellectual property and commercial litigation. He also has significant experience in many other areas of the law, including breach of contract, construction, fraud, antitrust, business interruption, marital dissolution, dealership disputes and tax litigation. Mr. Kinrich has testified numerous times in a variety of federal and state courts and other dispute resolution forums. Mr. Kinrich is a frequent writer and speaker for legal audiences. Mr. Kinrich's education consists of the following: MBA in Finance and Quantitative Methods, University of Maryland; M.S. in Statistics, Stanford University; and a B.A. in Mathematics, Pomona College, summa cum laude.

Russell (Russ) W. Mangum III, Ph.D.  Dr. Mangum has over 13 years experience in economic research. He has served as a consulting and testifying expert in the private sector, as well as for the U.S. Federal Trade Commission. His practice focuses on economic analysis and litigation support in a wide range of cases involving intellectual property, antitrust, class certification, and damage quantification. Examples of his work as an expert include estimation of lost profits and reasonable royalty in patent infringement matters; analysis of relevant antitrust markets; evaluation of exclusive dealing; and valuation of intellectual property used in consumer products, internet hardware, oil refining, advertising, and theme parks. Dr. Mangum has taught courses in economics, statistics, and econometrics at three colleges and universities. Dr. Mangum is currently an Adjunct Assistant Professor of Economics at the University of Southern California. Dr. Mangum's education consists of the following: Ph.D. in Economics, University of Southern California; M.A. in Economics, University of Southern California; and a B.A. in Economics, with honors, California State University, Fullerton.

PROGRAM DESCRIPTION:
Mr. Kinrich and Dr. Mangum will discuss results from recent research on patent licensing royalties in patent pools. In their presentation, they will discuss the typical structure of patent pools in terms of technology and rights contributed and compensation to patent holders. They will also discuss the economic and industry conditions that facilitate patent polls, and the implications of their research on patent licensing practices, and reasonable royalties as damages in patent litigation. An infringement case study will be used to illustrate best practices learned.
