Patent Reform, Can we get it Right?
Harry Gwinnell, Vice President and Chief IP Counsel of Cargill
There are at least 20 significant changes being proposed to the Patent Laws
in the various bills pending in Congress. The "good intentions" of
the proposals are to improve patent quality, speed up the patenting process,
reduce the cost of patent enforcement, etc. However, the perspective on whether
the individual changes make things better or worse differs dramatically by
trade association and industry. All that being said, there is an opportunity
here to really get it right, to strengthen the patent system, and to reinforce
the real intention of our Forefathers when then included the concept of patents
in the Constitution, to foster innovation and fuel the economy.
