"FINE TUNING YOUR LICENSING PROGRAM AFTER EBAY AND MEDIMMUNE"

Summary:
The Supreme Court's decisions in the eBay and Medimmune cases have significantly changed how you need to think about licensing. eBay threw out the Federal Circuit's general rule that permanent injunctions will issue against patent infringement absent exceptional circumstances, and reiterated the traditional four-factor test to determine when equity supports a permanent injunction. Medimmune gave the licensee a much stronger ability to challenge the validity of a licensed patent, while keeping the license in place.

These decisions may embolden prospective licensees and make it more difficult for patentees to license their patents. How should you respond as either a licensee or a licensor?

These and other licensing issues will be considered in this presentation by Thomas G. Berry of the Minneapolis office of Ingrassia, Fisher & Lorenz. Mr. Berry is formerly Vice President & Chief Patent Counsel of Medtronic, and has substantial experience in intellectual property strategy, procurement, licensing and litigation. Prior to joining Medtronic, Mr. Berry was with Motorola for twenty-one years in various engineering and legal positions, culminating in his election as Vice President & IP Law Director. At Motorola, Mr. Berry had worldwide intellectual property responsibility for all communication business units generating approximately 70% of Motorola's revenue at that time.

Merge onto MN-280 via exit number 23A.
Take the exit toward TERRITORIAL RD/UNIVERSITY AVE.
At the first stoplight, turn RIGHT onto TERRITORIAL RD.
Turn RIGHT onto Westgate Drive and take a right into the parking lot at 1000 Westgate Drive.
Park in any of the convenient open spaces in the lot, and enter the conference center through the doors under the UEL awning.

Coming from the east or west, I-94
Take the MN-280/UNIVERSITY AVENUE exit.
Take the exit toward UNIVERSITY AVE and go straight through 2 lights - Franklin and University.
At the stop sign, turn LEFT onto TERRITORIAL RD.
Turn RIGHT onto Westgate Drive and take a right into the parking lot at 1000 Westgate Drive.
