INVITATION TO A BREAKFAST MEETING ON WEDNESDAY, OCTOBER 8, 2008

You are invited to a breakfast meeting on October 8, 2008 at 7:30 a.m., sponsored by the firm of Leger Robic Richard, l.l.p., to be held at their offices located at Centre CDP Capital, 1001 Square-Victoria, Bloc E - 8th Floor in Montreal.  On this occasion, the LES will have the pleasure of receiving as its guest Me  Louis Carbonneau, Senior Corporate Attorney for the Microsoft Corporation Me Carbonneau will give a talk on "Microsoft and the Open Innovation Model". The presentation will be given in French.

Microsoft is generally associated with a closed innovation model, based on its leading proprietary technologies, such as Windows and Office, which over the years have created their own ecosystem to which others would have to adapt or perish.  It is difficult to alter preconceived notions and few people recognize to what extent Microsoft has, in the last several years, become a leader in the open innovation model.  Such open innovation model states that technology companies cannot afford to rely solely on their own research and development to feed their product pipeline, nor can they expect to use everything they’ve developed.  What results is the need to exchange ideas and discoveries with external parties in order to speed up the process of getting new innovations to market and an opportunity to recoup R&D costs that it cannot profit from directly. At Microsoft, this model has brought new life to traditional licensing activities in addition to creating new opportunities for orphan technologies through IP Ventures.  5 years and 500 agreements later, what’s the status?

At Microsoft, Me Carbonneau oversees the legal and intellectual property support for various business groups, including the Unlimited Potential Group that is developing technologies and solutions for the next 5 billion users. Until recently, Me Carbonneau was the General Manager of IP Licensing, in the Intellectual Property & Licensing Group where he was responsible for the outbound licensing activities for Microsoft research and incubation technologies. Prior to that, he was the GM of the International IP group, where he managed the IP and transactional legal teams providing support for all Microsoft Research groups worldwide, the Office of the CTO, the Advanced Strategies Group and for all non-US product development activities around the world.  Me Carbonneau spent several years of his career at Microsoft in the patent group and he himself holds a patent on a watermarking related technology. Prior to joining Microsoft in 1995 (as the general counsel of the then Montreal based subsidiary Softimage), Me Carbonneau was specializing as an IP litigator with the Smart & Biggar law firm.

Microsoft est généralement associée à un modèle d’innovation fermée, basée sur ses technologies vedettes, telles Windows et Office, qui ont au fil des années créé leur propre écosystème auquel les autres doivent s’ajuster ou périr. Les idées préconçues ont la vie dure et peu savent à quel point Microsoft s’est ouverte depuis plusieurs années et est devenue un chef de file du modèle d’Innovation Libre (Open Innovation). Ce modèle stipule que les sociétés œuvrant dans les secteurs technologiques ne peuvent plus se permettre de développer elles même tout ce qu’elles devront utiliser, ni d’utiliser tout ce qu’elles ont développé. Il s’ensuit un besoin d’échanges pour accélérer la mise en marché et une opportunité de recouper les investissements de R&D qui n’ont pas pu être mis à profit directement. Chez Microsoft, ce modèle a donné un nouveau souffle aux activités traditionnelles d’octroi de licences en plus de créer de nouveaux débouchés pour des technologies orphelines, par le truchement de IP Ventures.  5 ans et 500 ententes plus tard, quel est le bilan?

Chez Microsoft, Me Carbonneau chapeaute l’ensemble des activités juridiques et de propriété intellectuelle de l’entreprise à travers différents groupes d’affaires, incluant le groupe Unlimited Potential qui développe actuellement des technologies et solutions pour les prochains 5 milliards d’utilisateurs. Avant d’occuper ses fonctions actuelles, Me Carbonneau était Directeur général de licensing de propriété intellectuelle du groupe de propriété intellectuelle et licensing de Microsoft, et il était auparavant Directeur général du groupe international de propriété intellectuelle où il dirigeait l’ensemble des activités juridiques de propriété intellectuelle et transactionnelles. Me Carbonneau a passé plusieurs années chez Microsoft au département brevets et détient lui-même un brevet pour une technologie dans le domaine du tatouage numérique. Louis Carbonneau s’est joint à Microsoft en 1995 à titre de Chef du contentieux de l’entreprise québécoise de développement de logiciels Softimage, alors filiale de Microsoft. Auparavant, il faisait partie du cabinet canadien Smart & Biggar, spécialisé en propriété intellectuelle.
