A panel of experts will tackle a hypothetical negotiation of license terms
for a new medical device. The panel will break down the negotiation and
provide a glimpse into the thoughts and strategies of the parties. Life
sciences tech transfer consultant Sandy Shotwell of Alta Biomedical, and Keith
Jones, Executive Director for the Washington State University Research Foundation,
will represent the licensor's interests, while John Villa, senior licensing
strategist from HP, and Mike Cohen of Schwabe will represent the interests
of the licensee.
Speaker Bios:
Keith Jones
Keith Jones is the Executive Director of the Washington State University
Research Foundation whose mission it is to facilitate the efficient transfer
of technology, proprietary information, and inventions from Washington State
University (WSU) to the private sector. Keith was the former director
of commercialization in life sciences for Virginia Tech Intellectual Properties
Inc. Before moving to Virginia Tech, Jones was scientific adviser to Lyon & Lyon
LLP in San Diego, one of the largest intellectual property law firms in the country.
Jones was involved in litigation involving key patents in plant biotechnology.
He also has worked for Mycogen Corp. in San Diego, in international technical
development and marketing and as a research scientist.
Sandra Shotwell
Sandra Shotwell is a Founder and Managing Partner of Alta Biomedical Group,
a consulting firm specializing in technology commercialization. Her clients
include both early-stage and established companies, as well as research institutions
and non-profit organizations. Her market focus is in the life sciences
and related areas.
Dr. Shotwell has over twenty years experience in technology management on
behalf of U.S. and international research organizations and corporations. She
has done extensive license negotiation, developed business strategies, worked
with numerous start-up companies, and managed technology and research administration.
Her technology management experience includes positions at Stanford University
and the European Union's Joint Research Center. She established the National
Institutes of Health (NIH) Technology Licensing Branch, where she directed
licensing for the NIH, the Centers for Disease Control, and the Food and Drug
Administration. She served as Director of Technology and Research Collaborations
at Oregon Health Sciences University, with responsibility for technology licensing,
company spinout formation, research grants and contracts and company-sponsored
research. While at OHSU she assisted in the creation of six new spinout companies. She
continues to serve clients in the area of early stage technology commercialization.
Dr. Shotwell currently serves on the Board of Directors of the Oregon Bioscience
Association, the International Sustainable Development Foundation and the Electronic
Product Environmental Assessment Tool. She has previously served on the Boards
of Virogenomics, Inc., the Stanford OTL Gap Fund and the Association of University
Technology Managers. She is active in the Licensing Executives Society, and
the Association of University Technology Managers.
John Villa
John Villa is currently a senior licensing professional within Hewlett-Packard’s
Imaging and Printing Group (IPG). His focus is on assisting new product development
in patent, trademark and copyright in-licensing, company acquisitions, joint-ventures
and IP analysis; additionally he is responsible for out-licensing of IPG IP. His
background extends to Acting-Director and Licensing Officer at the University
of Washington; Senior Manager IP Marketing and Senior Licensing Executive for
the Boeing Commercial Airplane Group; and Business Unit Manager within the Intellectual
Property & Licensing Organization. He holds an MBA in Technology Management.
Mike Cohen
Mike Cohen is a shareholder with Schwabe, Williamson & Wyatt and co-chair
of Schwabe's Intellectual Property Practice. He focuses his practice in the areas
of patent, trademark and copyright licensing; counseling, prosecution, enforcement
and litigation of trademark, trade dress, trade secret and copyright rights;
technology transfer; IP due diligence for mergers and acquisitions; internet/e-commerce
counseling; domain name and website issues; and entertainment, media and advertising
law, including negotiating and enforcing book, music and movie deals and royalty
agreements.
