The LES – Ottawa Chapter together with the Intellectual Property Institute of Canada ("IPIC") Ottawa Informals Group are pleased to present the following seminar:

TOPIC:
"
Patent Trolls or Patent Licensing: Is there a difference in tactics or just nomenclature?"

SPEAKERS:
Grant W. Lynds & Christopher C. Van Barr, Gowling Lafleur Henderson LLP


Background:

Patent "trolls" have garnered a great deal of attention lately in the U.S. and Canada, and especially in the mainstream business media since the NTP v. RIM patent infringement litigation. But is there really anything new about "patent trolls", or are we merely referring to established licensing activity and practices by another name? Grant and Christopher have significant and complementary experience in dealing with patent litigation, and will cover a variety of issues that relate to the distinctions, if any, between patent troll strategies and patent licensing.

Grant Lynds is a partner at Gowlings' Ottawa office where he practises intellectual property litigation, including pharmaceutical patent litigation and related counselling. Before joining Gowlings, Grant gained private practice experience in patent and trade mark litigation, and also spent a number of years as in-house litigation counsel with a multinational telecommunications company. In that role, Grant managed U.S. and Canadian litigation, arbitration and mediation in a variety of subject areas, including patent and copyright infringement, breach of contract and product liability. Before attending law school, Grant practised as a production engineer with a large integrated petroleum company in Calgary, and during that time he also gained experience working in the company's internal audit group. He is also a registered patent agent in Canada, a patent attorney in the United States, a trade mark agent in Canada, and has been admitted to the New York state bar.

Christopher Van Barr is a partner at Gowlings' Ottawa office where as an intellectual property litigator he has appeared as lead trial counsel and appeal counsel on numerous cases before the Federal Court of Canada, Federal Court of Appeal, Ontario Court, and Ontario Court of Appeal. He has acquired a particular expertise in patent, trade mark, copyright and trade secret litigation, and PM(NOC) proceedings, while acting for leading national and international software, hardware, pharmaceutical and manufacturing industry clients. Christopher also has considerable experience in litigation concerning computer software including anti-piracy and anti-counterfeiting cases. Christopher is also a registered patent agent in Canada. Prior to joining Gowlings, Christopher was corporate counsel (intellectual property/litigation) with Corel Corporation.
