Patent licensing has been described as a technique for generating "infinite return on investment," and has also been described as a way of enabling competitors to put you out of business. It can also be used to set up your technology as a de facto industry standard.
This presentation will contrast patent licensing to other tools for extracting value from intellectual property and examine the essential licensing models. Should the license be based on fixed fees or a percentage? What's the right percentage? What else can you license besides patents to create a licensing package giving maximum value to the licensee and maximum return to you? What options do you have when the patent is still pending? How to audit your patent portfolio?
According to one study, 67 percent of U.S. companies own technology assets they fail to exploit. These wasted assets are valued at more than $115 billion. Once IBM began mining its IP portfolio, it saw an increase in patent royalty income from $30 million in 1990 to $1 billion in 2000. With a successful patent licensing strategy, you can generate substantial revenue too!
ROBERT P. COGAN is a Partner in the San Diego office of Nath & Associates, a boutique patent and trademark procurement law firm. Mr. Cogan's area of practice includes all aspects of intellectual property law including patent and trademark prosecution and litigation, trade secrets, licensing, computer law and copyrights. He is actively involved in all aspects of client counseling involving development of intellectual property portfolios and exploitation of technology, commercial technology transactions, software licensing and government contracting. Mr. Cogan counsels clients across a broad range of technologies, including electronics, digital systems, computer processors, software programs and architectures, telecommunications and the Internet, semiconductor manufacturing, systems integration, medical devices, business methods and sophisticated mechanical devices. Prior to returning to private practice in 1997, Mr. Cogan was, during the 1980s and 1990s, chief patent counsel of EG&G, Inc, then a Fortune 200 company with diversified high technology operations on all seven continents. His prior experience also includes operational management in a medical devices company and extensive licensing work. Mr. Cogan began his patent career in the General Electric Company Patent Lawyer Development Program in Washington, D.C. in 1966.
