PROGRAM DESCRIPTION:
Three experienced antitrust lawyers will talk about some of the current and important antitrust issues that can arise in licensing intellectual property. Topics will include unilateral refusals to license, licensing in the context of standard setting organizations, contracting around Medimmune, and collecting royalties after the expiration of the patent. SPEAKERS’ BIOGRAPHIES
Brian Brosnahan: Brian Brosnahan joined Heller Ehrman in 1984 and practices primarily in the areas of antitrust and unfair business practices. He has handled antitrust litigation and counseling engagements for clients in numerous fields, including the credit and debit card industries, pharmaceuticals, and medical devices. He is a member of the Antitrust & Trade Regulation, Complex Commerical Litigation and Consumer Litigation Practice Groups. Mr. Brosnahan has provided advice and litigation representation to companies facing extremely serious or "crisis" litigation threats. Such representation has included antitrust or unfair business practices class actions (such as his representation of Visa U.S.A. Inc. in tying and monopolization litigation involving debit and credit cards and his representation of Providian Financial Corporation in various federal and state unfair business practices class actions). That representation has also included representation of clients facing severe tort exposures, where his experience in managing litigation and pursuing insurance carriers has proven invaluable in protecting his clients. As outside general counsel of the Franciscan Friars in the western states, he has helped the Franciscans avert financial disaster while resolving sexual abuse cases with compassion and dignity, setting a model since the early 1990s for how religious organizations ought to approach the sexual abuse crisis. While Mr. Brosnahan typically represents defendants, he knows the plaintiff side as well. Mr. Brosnahan has represented plaintiffs in antitrust and unfair business practices litigation and has frequently sued insurance carriers on behalf of large corporate insureds.
Mr. Brosnahan is the former co-chair of the Financial Markets and Institutions Committee of the American Bar Association’s Section of Antitrust.
David M. Goldstein: David M. Goldstein joined Heller Ehrman in 1989. He serves on the Executive Committee of the firm’s Antitrust & Trade Regulation Practice Group, and is a member of the firm’s Complex Commercial Litigation Practice Group. Mr. Goldstein is a former co-chair of Heller Ehrman's San Francisco Litigation Department and also has served on the San Francisco Office Management Committee. Mr. Goldstein has litigated high-stakes antitrust cases in a variety of industries. He currently represents Sony in multi-district litigation asserting price-fixing claims in connection with Static Random Access Memory (SRAM). He represented Visa in a massive antitrust class action involving the payment card industry in which Wal-Mart and other merchants asserted Section 1 and Section 2 claims seeking trebled damages in excess of $100 billion, and also represents Visa in follow-on state consumer class actions that were filed in 20 states asserting antitrust, unfair competition and common law claims. He recently represented Texas Instruments defending against Section 1 and Section 2 claims with respect to standard setting for DSL technology, and he previously represented Pennzoil-Quaker State in a civil action challenging their merger. Mr. Goldstein also has provided counseling with respect to antitrust issues in licensing agreements, trade association activities and mergers. In addition to antitrust matters, Mr. Goldstein has represented clients in a variety of areas, including the False Claims Act, unfair business practices, investment management services, insurance coverage, real estate and other business disputes. He also has represented clients in matters involving the First Amendment.
Jim Basta: Jim Basta is Associate General Counsel at Biogen Idec in San Diego working in the corporate group. He represents the oncology business unit on a variety of matters including regulatory compliance and business development transactions such as licensing and acquisitions. Prior to Biogen Idec, he worked in private practice as a transactional attorney with Pillsbury Winthrop Shaw Pittman, Baker & McKenzie and Sidley Austin. He received his JD from Northwestern School of Law.
