Mega Bloks Wins in Supreme Court - Lego's Rights in Toy Bricks Denied– Supreme Court of Canada – The decision and what it means

The Supreme Court of Canada has given Canadian toymaker Mega Bloks a final victory in a long-standing trade-mark lawsuit over the use of the shape of connecting studs on toy bricks in its marketing materials. Lego had argued that the manner in which Mega Bloks marketed and advertised its toy bricks infringed Lego’s trade-mark rights in Canada, and could cause confusion between the two companies’ products. In a decision released on November 17, 2005, the Supreme Court rejected Lego’s argument. Justice LeBel, writing for a unanimous Court, held: “MEGA BLOKS and LEGO bricks may be interchangeable in the bins of the playrooms of the nation – dragons, castles and knights may be designed by them, without distinction.”

The LES Toronto Chapter, is pleased to have Ron Dimock, counsel for Mega Bloks in the Supreme Court of Canada, available to explain the Supreme Court ruling and its significance.
