In Eli Lilly v. Apotex, the Federal Court of Appeal recently clarified a number of issues surrounding the application of competition law to licenses and transfers of intelectual property. In this talk, we will hear about:
- the Federal Court's "new" approach to considering licenses and transfers
- New issues raised by the Court's decision
- What you should be advising your client on the applicability of competition law to IP transactions
Brad Limpert is a partner of the firm Gowling Lafleur Henderson LLP, based in the Toronto office. He is co-chair of Gowlings' National Technology Industry Practice Group. His practice encompasses many areas that are of key concern to technology based businesses, including Technology Contracting, Finance, Intellectual Property Audits and Strategy and Litigation. His book, "Technology Contracting: Law, Precedents and Commentary" was published in 2005 by Carswell.
