Copyright law has become one of the most contentious intellectual property laws in Canada, challenging even the regulation of pharmaceuticals. When the current government indicated its intention in December 2007 to introduce amendments to the law a debate started immediately regarding the possible contents. To date no amendments have yet been introduced, possibly because of the instant controversy that arose between proponents of owners’ rights and proponents of users’ rights.
Our panel will discuss the current state of the law, why some feel amendments may be needed and what they might be, and how both the current state and possible amendments affect innovation and technology transfer issues.
Chabriol obtained her LLB from the University of Sydney in 2001 and worked as an intellectual property lawyer in Australia, advising a range of clients on copyright issues, from publishers to fashion designers to school boards. She now works for the C4, a consortium of 6 universities in Southwest Ontario, providing copyright advice and assistance in relation to the use, protection and commercialization of copyright materials.
Virginia obtained her LLB from Dalhousie University in 2002. She also has degrees in Biology and English literature and is currently working on an MBA. She is in-house counsel at Access Copyright. In this capacity, Virginia provides advice to producers of creative content and has worked on a number of policy issues. She has worked extensively with Creative Commons and the Wikimedia Foundation in the development of a Canadian Public Domain Registry. Virginia has also worked with the Creators Rights Alliance, helping creators identify new business models and the challenges they face in the digital environment.
Andrea is an intellectual property lawyer, a registered patent and trade-mark agent. She has acted as lead counsel before Supreme Court of Canada, Federal Courts, Supreme Court of Ontario, Trade-marks Opposition Board and Copyright Board.
Andrea served as the Vice-Chair of the Law Society of Upper Canada, Specialty Committee on Intellectual Property and chaired this years LSUC IP Year in Review, as Vice-president of ALAI, Trustee, Copyright Society of the USA, and on various Editorial Boards including the Copyright Journal of the US Copyright Society, CBAO Federal government advisory committees include Information Highway Advisory Council (Copyright Subcommittee), a Sectoral Advisory Group on International Trade (Business Services SAGIT), and Expert Committee on Domain Names (Industry Canada).
