TITLE: “Licensing in China: The Good, the Bad and the Ugly”

Licensing IP/technology to China raises well-founded concerns of losing the IP/technology to piracy or competitors.  Yet many North American companies do business in China successfully.  What are some of the best ways for protecting patents, trademarks, copyright and technology when licensing to China?  What are the pitfalls? Our two speakers will share their insights on this important topic.

Tarif Korabi is Vice President of Marketing and Sales at Hatch Steltech Ltd.  He has 31 years of licensing experience, including several years in China.  He will tell the audience about the non-legal techniques that have worked for his engineering firm and that have allowed his firm to keep some control on their proprietary technology and market share for themselves, even while contracting Chinese firms to build the sophisticated equipment.

Toronto lawyer Paul Jones will provide legal pointers.  Paul is a licensing, IP and competition lawyer who speaks Mandarin Chinese.  He will speak on the rule of law in China, the general contract law adopted in 1999, its provisions on technology contracts, and more specifically, on the Supreme Court Commentary on Disputes Involving Technology Contracts released in December 2004.  From his comments the audience will have an idea of how far they can use contracts to protect IP/technology in China.
