Executing Multi-Institutional IP Development Agreements In Canada

The pervasive development of the knowledge-based global economy, and with it, the growing importance of intellectual property rights, have served to complicate both the negotiation, and the execution, of multiparty IP agreements.
Agriculture and Agri-food Canada commissioned a study of barriers to the execution of multiparty research agreements. Our purpose was to survey the prevalence of, and outcomes from, multi-institutional research agreements. Using international comparisons, we wished to assess Canadian performance in executing these agreements, identify better practices available elsewhere, and provide options for improving Canadian outcomes from multiparty agreements.
John is the director of the Office of Intellectual Property and Commercialization at Agriculture and Agri-food Canada (AAFC). He has worked at AAFC’s headquarters since 1997, with most of his time devoted to developing commercial technology transfer capacity and doing research and technology transfer agreements. John is a soil physicist by training, and has been working at AAFC most of his career.
Stan is a Senior Counsel in the Regulatory Section of Justice Canada, Ontario Regional Office (Toronto). He has a BA (Hons.) RMC (’77), LL.B Calgary, and LL.M (IP) Osgoode. He acts for Agriculture Canada, Research Branch (technology transfer /licensing) and Agriculture Canada International Science Branch (animal / plant genetics / biodiversity treaties). He has written articles on: IP rights and the regulatory regime concerning agricultural crops; the regulation of genetically modified crops; the precautionary principle, and technology transfer in government. He is also a Ph.D. candidate (Labeling of GM Foods – Right to Know or Need to Know) Osgoode Hall, York University.
