Mediation and arbitration are cost-effective alternatives to litigation
in licensing disputes. Disputes over the scope of a license, royalties
owing, ownership of jointly developed IP, and other contract obligations can
be resolved without going to court. Mediation is especially useful
in situations where both parties have an interest in continuing a business
relationship, but run into problems along the way. Arbitration is useful
where there are specific legal or technical issues that need to be resolved
quickly.
Michael Erdle is Managing Partner of Deeth Williams Wall, a Toronto technology
and intellectual property law firm, and is currently the president of the Intellectual
Property Institute of Canada. He has practiced intellectual property
and technology law for almost 20 years, with an emphasis on licensing, joint
ventures and commercialization of information technology. Michael has
acted as both mediator and arbitrator and has advised many clients in litigation
and alternative dispute resolution.
