IP Rights - Exceptions to the Rule - Canadian and U.S. Perspectives or (How May I Use My Competitors' Intellectual Property and How May They Use Mine?)

If you want to use another company's IP, the conventional wisdom is that you had better get a license. However, there are exceptions to copyrights and patents that can permit others to use the IP without permission. These exceptions may allow:

  • copying from books, articles or diagrams;
  • experimentation with a patented machine, drug or computer method;
  • use of a patented research technique to obtain data for submission to the FDA or Health Canada;
  • a 'prior user' to continue using an invention patented by another company.
Our expert speakers will explain how to try to either exploit or plug potential loopholes in US and Canadian IP rights.

About the Speakers:

Dan Oliverio
Dan Oliverio is a partner at the Buffalo Office of Hodgson, Russ LLP. Dan is a member of the Dispute Resolution and Intellectual Property Groups. He is among the Firm's practice leaders in both civil and criminal litigation. His current practice includes complex litigation involving high-dollar, high-exposure issues for business clients, primarily before the United States District Courts. By virtue of his technical background, he is known for his ability to handle cases involving scientific or technical issues very smoothly.

Brian Gray
Brian Gray is a partner in McCarthy Tétrault's Technology, Communications and Intellectual Property Group in Toronto. Recently Mr. Gray's practice has focused on litigation and dispute resolution in the patent, copyright, entertainment, trade-mark and advertising areas. He counsels clients with large patent and trade-mark portfolios and advises on copyright and entertainment matters.
