"Monsanto Canada Inc. et al. v. Schmeiser et al.: Implications For The Canadian Farmer"

Farming is a commercial enterprise. Huge investments have been spent on developing better seeds and plants. One way to protect the investment is through the Patent Act. The scope of protection provided by the Patent Act for such developments and its impact on farmers was addressed in the Supreme Court of Canada decision of Monsanto v. Schmeiser that was released on May 21, 2004.

ROGER T. HUGHES, Q.C. is one of the leaders of the Intellectual Property Bar in Canada. He has appeared as lead counsel in the litigation of many of the significant Intellectual Property cases in the Canadian Courts including being counsel for Monsanto on the aforementioned case. Mr. Hughes will share with us his insights and the implications that this Supreme Court of Canada decision has on biotechnology patenting and licensing in Canada.
