TITLE: Broadened Rights for Famous Marks in Canada: A Review of the Supreme Court of Canada's Decisions in Veuve Clicquot and Mattel (Veuve Clicquot Ponsardin v. Boutiques Cliquot Ltée, 2006 SCC 23 & Mattel, Inc. v. 3894207 Canada Inc., 2006 SCC 22)

In these two important decisions rendered in 2006, the Supreme Court of Canada has put Canadian law as to the protection of famous trade-marks back on course. While the Court ultimately dismissed appeals by the owners of the famous marks VEUVE CLICQUOT and BARBIE in these cases, the Court went on to reject limitations that had previously been placed on the scope of "confusion" protection for famous brands by the Federal Court of Appeal's decision in United Artists Corp. v. Pink Panther Beauty Corp. (1998), 80 C.P.R. (3d) 247.

In addition, the Supreme Court of Canada has breathed new life into s. 22 of the Trade-marks Act, providing guidance that should pave the way for its future application as an anti-dilution remedy of particular importance to famous brand owners.

Kevin Sartorio is a senior associate in Gowlings' IP Litigation Group with a practice extending to all areas of intellectual property litigation. Along with Scott Jolliffe he served as counsel to the International Trademark Association (INTA) for its intervener submissions to the Supreme Court of Canada in the Veuve Clicquot decision. Gowlings was also counsel to Mattel, Inc. in the Mattel decision, heard the same day as Veuve Clicquot.
