Prospecting for Deals: Intellectual Property Strategies that Drive Improvement in Licensing and Business Development Performance

Sourcing new products and technologies in life sciences has driven substantial growth and increased visibility for licensing and business development (L&BD) professionals. Big Pharma wants to be seen as a great partner for biotech companies, speed to complete transactions has become increasingly critical in the face of competitive bidding among Big Pharma companies for access to biotech opportunities, and deals have moved farther back in the R&D pipeline. Hidden Treasure: Recent Royalty Rates and Deal Terms from the LES 2007 Survey
This just in! The LES 2007 BioPharmaceutical Royalty Rate & Deals Terms Survey has yielded a gold mine of timely information, unavailable through any other source, with landmark data from over 250 submitted deals from the past three years, across multiple therapeutic areas and development stages, including contribution of hard-to-obtain data for a high number of preclinical deals. Patent Valuation - Is There One or Many?
As difficult as determining the technical merit of a patent may be, setting the financial value of patents and patent portfolios is a dark art. Is it possible there is no single correct value?

Consider present day litigation valuation techniques such as those derived from Georgia Pacific. Or, the value determined in fast rising patent auctions - with and without extensive engineering evaluation. Technology licensing often includes patent licenses, but at what value? What about patent license negotiations initiated to forestall the need for litigation? Is the valuation of a portfolio of patents the summation of the worth of the individual patents within? Do - or should - patent brokers arrive at yet another value? Based on evaluation, are essential patents more valuable than non-essential patents? Does the value of a patent change with stage? Finally, in a bankruptcy fire sale, what is fair?

A panel discussion directed at sharing thoughts on these questions will attempt to illuminate this matter. The audience will have ample opportunity to question what they hear or don't hear.

Licensing Essential Patents and the Interplay with the Standards Development Organizations
The panelists for this session have various experiences in standards development, government review of the standards IP rules and licensing policies, as well as essential patent licensing experience. They will present their perspectives on the legal framework and business issues in working with standards development organizations and the issues surrounding essential IP to a standard. Among the topics to be discussed are the obligations contributors have to the standards development organization to disclose IP essential to a contribution and what it means to license essential patents on fair, reasonable and non-discriminatory terms.

Choices, Choices and More Choices for Fuels of the Future
While it is expected that fossil fuels will continue to play a significant role in energy sourcing, this mini-plenary session will examine some of the challenges and tensions in developing commercialization and widespread adoption of biofuels and fuel cells - and the licensing marketplace that is beginning to emerge. Speakers from different geographic regions of the world and different organizations - start-ups, government, universities and energy companies- will provide attendees a head start in unraveling the choices.

This mini-plenary will focus first on various new technologies being developed including an important initiative by DOE, the licensing models being used by leading non-profits, and financing perspectives; the second portion will focus on hydrogen and fuel cells.

Attendees will also be able to learn about the progress of FutureGen.

"FutureGen is an initiative to build the world's first integrated sequestration and hydrogen production research power plant. The $1.5 billion* project is intended to create the world's first zero-emissions fossil fuel plant. When operational, the prototype will be the cleanest fossil fuel fired power plant in the world. "

Global Medical Device Collaborations and Licensing: A Comparative View from Canada, Europe and the USA
This session will address issues arising in today's global collaborative environment. This workshop will discuss patent strategies to protect collaborations. A comparison of patent laws will address novelty/obviousness (Post-Teleflex); protecting therapies/device usage; and understanding patent opposition practice. Enforcement issues relating to medical devices, including comparative reviews of doctrine of equivalents, contributory infringement, and remedies (e.g.,EBAY injunctions) will be considered. Multi-national litigation concerns will also be addressed.  Finally, defining expectations and responsibilities of collaborators and critical hurdles toward commercialization including regulatory differences across jurisdictions will be considered.
