PDS Workshops
Each of these Professional Development Series (PDS) Workshops meets one of the PDS Workshop
requirements for the intermediate-level series certificate. They are open to all meeting attendees
on a space-available basis. Because class size is limited to 35, both PDS students and other interested
participants are asked to sign up for each Workshop in advance by marking the appropriate
boxes on the Meeting Registration Form. Check for any remaining spaces at the LES Registration desk on-site at the Meeting. To find additional

(LEGAL) Workshop

Legal Issues in Licensing
Learn the reasonable measures that U.S. companies can take to protect trade secrets. Explore the role of contracts in protecting trade secrets. Find out what constitutes "misappropriation" of trade secrets and the legal remedies available. This interactive workshop will help you conduct audits, educate employees, and structure agreements that protect this valuable intellectual property.

Indemnification: Don't Bet the Company!
The obligation to indemnify a licensee can be a multi-million dollar risk exposure. This interactive session will use focus on indemnification provisions included in many license agreements. The Workshop will include a review of indemnification provisions included in agreements and how such provisions allocate certain risks between the parties. Participants will learn from other participants how different companies deal with this key risk management provision. After participating in this Workshop, licensing professionals will be able to more productively analyze or re-analyze their own indemnity provisions offered to customers/ licensees and the indemnification offered by third party licensors/ sellers.

PDS 201 (LEGAL) Workshop

Winning the IP Game through Strategic Decision-Making
Both business executives and lawyers will learn the value of patents and other IP by making strategic decisions on patentability, examination, and protection from litigation. The workshop uses a real-life example as the foundation for a business simulation where participants work to make decisions on what, where, and how to build IP protection, as well as what to do when patents are asserted against them. Participants will get hands-on experience and knowledge of the different pathways they can take, and will learn the financial costs and strategic consequences of their decisions. In particular, they will learn how well-constructed IP protection can help them avoid, or minimize, costly litigation, and set themselves up to better commercially leverage their IP portfolio. Participants in this workshop will also learn about the relevance of recent patent rulings and the effects these rulings will have on their IP and on their bottom line. Note: This workshop is for those who have taken the LES Fundamentals course or who have experience equivalent to three or more years in the licensing profession.
